Terms of Service

1. Acceptance of Terms

By downloading, installing, or using RewriteCmd ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. RewriteCmd is developed and operated by Hyperstack Studio ("we", "us", "our").

2. Description of Service

RewriteCmd is a macOS desktop application that rewrites selected text using third-party AI services. Free and Pro Cloud route rewriting requests through our server and the Cloud AI services described in our Privacy Policy. Pro Lifetime and supported existing Pro licenses connect directly to your own ChatGPT account or API provider.

3. Eligibility

You must be at least 13 years old to use RewriteCmd. By using the App, you represent that you meet this requirement. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Your API Keys and Accounts

• Pro Lifetime requires your own eligible ChatGPT account or API key from a supported provider (OpenAI or Anthropic). Cloud AI is not included with Lifetime; Pro Cloud includes AI without a personal API key.
• You are solely responsible for maintaining the security of your API keys and for all usage and charges incurred through those keys.
• API keys are stored locally in your macOS Keychain. We never transmit or have access to your keys.
• Your use of third-party AI providers is subject to their respective terms of service and usage policies.

5. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use RewriteCmd on macOS devices that you own or control.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse-engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels
• Use the App to violate any applicable law or regulation
• Sublicense or transfer your license to any third party

6. Paid Plans

RewriteCmd offers a Free plan with 50 AI rewrites offered once per Mac and one instruction shortcut, Pro Cloud at $9 per month or $79 per year, and Pro Lifetime at $39 once, paid through Stripe. All prices are in USD and include applicable taxes. Personal AI connections require Pro Lifetime or a grandfathered Pro license. Pro Cloud includes 2,000 rewrites per UTC calendar month, without rollover, and a limit of 10 requests per minute per license. Invitation trials include 50 total Cloud rewrites until their stated expiry. Pro Lifetime includes unlimited shortcuts and updates within the current major version; it does not include hosted AI or future major versions. A paid license is bound to one Mac.

• Billing: By subscribing to a paid plan, you authorize us to charge your payment method on the selected monthly or annual schedule until you cancel. Lifetime is a one-time purchase.
• Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Refund requests can be sent to support@hyperstack.studio. This does not limit mandatory consumer withdrawal, refund or other statutory rights.
• Price changes: We may change subscription pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

7. Acceptable Use

You agree not to use RewriteCmd to:

• Generate content that is illegal, harmful, threatening, abusive, or harassing
• Violate the terms of service of any AI provider you connect to
• Infringe on the intellectual property rights of others
• Transmit malware, viruses, or other harmful code
• Interfere with or disrupt the App or related services

8. Intellectual Property

RewriteCmd, including its design, code, and branding, is the property of Hyperstack Studio and is protected by copyright and intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

Content you create or rewrite using the App belongs to you, subject to the terms of the AI provider you use.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy for details on how we handle your data. Personal-AI text processing takes place between your Mac and your chosen provider. Free and Cloud text pass through our server and the Cloud processors named in our Privacy Policy; our application does not log or store the text in quota storage.

10. Disclaimer of Warranties

RewriteCmd is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• AI-generated rewrites will be accurate, appropriate, or suitable for any purpose
• Third-party AI services will be available or perform as expected

11. Limitation of Liability

To the maximum extent permitted by applicable law, Hyperstack Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, arising out of your use of RewriteCmd.

Our total aggregate liability for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Hyperstack Studio from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to RewriteCmd at any time, with or without cause, with or without notice. Upon termination, your license to use the App ends immediately. Sections 8, 10, 11, and 12 survive termination.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Paris, France.
